China Animal Law Forum 2019

The Mission of the Forum

    China Animal Law Forum (CALF) is designed to achieve a few short-term and long-term goals. It serves as a platform for exchanging ideas, experiences and successful or unsuccessful stories related to legal prosecution of animal abuse cases. It hopes to inspire prosecutors, law enforcement agencies, public health authorities, food safety inspectors, road safety offices, child development agencies and the society at large to use existing laws and policies that are seemingly unrelated to animal protection to prosecute animal abusers.  CALF is also a showroom for law students to present their legal action strategies against a real or a hypothetical animal cruelty act. The Forum aims to encourage legal actions within the confines of the Chinese laws against animal cruelty by utilizing existing laws and policies at a time when China is yet to adopt an anti-cruelty law.  The forum aims to tell the audience that they should not sit still and take no actions because of the unavailability of an anti-cruelty law. They can and should take actions by using other laws that are seemingly unrelated to animal protections to go after animal abusers. 

 

Participants of the Forum

    China Animal Law Forum (CALF) is oriented to Chinese law professionals, law (food safety, public health, transportation safety, traffic control, environmental protection, child protection etc.,) enforcement officers, prosecutors, law students, animal activists, educators, and youth rights advocates and other concerned members of the society. Speakers to CALF include Chinese and foreign legal experts, activists, prosecutors and law enforcement officers who have personal, professional or other related experience in successful or unsuccessful lawsuits against animal abusers. CALF is particularly interested in attracting the participation of law school students.

Expected Outcomes

    In the short-term, CALF aims to send the message that China’s law enforcement and all the concerned parties should not sit still and wait for the adoption of an anti-cruelty law to prosecute animal abusers; they do not need to wait; they can utilize the existing Chinese laws and policies that look seemingly unrelated to animal protection to prosecute animal abusers; they can creatively use relevant articles about food safety, for example, or about child protection to prosecute perpetrators who sell meat products from animals cruelly slaughtered or who brutalize animals in broad daylight. It is important that a consensus be established and awareness be reached among the relevant parties and individuals that China can still prosecute animal abusers even though it is 197 years behind the most progressive country in anti-cruelty legislation. Therefore, in the short-term, CALF aims to create the consciousness that “Yes, we do not have to wait for the arrival of an anti-cruelty law. We can do it by creatively using existing laws to achieve animal protection.”

    In the long-run, CALF aims to share stories, lessons learned and strategies for successful prosecution of animal abusers. It will also provide a bigger platform for law students to showcase their ideas, tactics, and their mastery of the laws and regulations for the prosecution of an animal cruelty case. It also hopes to serve as a venue for law professionals to form a national network of legal defense fund to assist government and courts through expertise assistance, evidence collection, and other services.
